Privacy Policy

This privacy policy is provided so that you, as the owner of personal data, have the freedom to make a free and informed decision regarding the processing of your personal data through the FAD application ("Firma Autógrafa Digital").

In compliance with the principle of information, through this privacy policy, you may find the following information: (I) Identify Muuk Technologies, S. de R.L. de C.V. (hereinafter "FAD®"), as the entity responsible for processing personal data; (II) Understand the purposes or actions that led to the collection, use, and custody of your personal data (processing of personal data); (III) Learn about third parties to whom your personal data may be transferred, when applicable, always in accordance with the respective applicable legislation; and (IV) Be aware of the mechanisms available for you to exercise your rights regarding the protection of personal data (ARCO rights: access, rectification, cancellation, or opposition). Therefore, we recommend that you read this notice carefully for further information.

1. Identity and Address of the Data Controller.

FAD® is a company legally constituted under Mexican law and will be individually responsible for the personal data it collects.

FAD® is located at Fuente de Pirámides #1-604, Colonia Lomas de Tecamachalco, Naucalpan, Estado de México, Postal Code 53950.

2. Personal Data Collected by the Data Controller.

The data we may request from you are as follows:

a. Personal Data:

  • Full name
  • Address
  • Unique Population Registry Code (CURP)
  • Federal Taxpayer Registry (RFC)
  • Date of birth
  • Gender
  • Photograph
  • Video of your face
  • IP address
  • Geolocation
  • Handwritten signature

b. Sensitive Data:

  • Facial, fingerprint, and/or behavioral biometrics.

c. Contact Data:

  • Email address
  • Mobile phone number

FAD® may obtain your personal data through the following means:

  • Directly from the user when using our services or applications.
  • Provided by your counterpart to carry out the digital signing process of a document.
  • Provided by the user as part of the identity verification process and/or for signing documents.

3. Purpose of Personal Data Processing.

FAD® will use your personal data for the purposes described below, which are necessary to provide our products and services:

  • Signing contracts, applications, and/or documents for products and services remotely, using the FAD platform (Firma Autógrafa Digital) and its derivative works.
  • Verifying the identity of the Data Subject, as well as the accuracy of the information and documents provided, in strict compliance with applicable regulations on customer identification and anti-money laundering.
  • Comparing certain collected personal data with official and/or private databases to confirm their validity and authenticity.
  • Authenticating the identity of users of our products; FAD will store user personal data while ensuring they are relevant, correct, and up-to-date, in compliance with applicable law.
  • Conducting necessary activities to provide multimedia digital signature services to internal and external users.
  • Providing technical assistance to customers, users, or potential customers regarding our services.
  • Charging for our services.
  • Formalizing contractual relationships with customers, suppliers, and employees, as well as for internal use.

4. Means of Communication to Limit the Use or Disclosure of Personal Data.

If you, as the end customer, wish for your personal data to::

  • Not be used for purposes other than those described;
  • Be updated;
  • Have limited use;
  • Have limited disclosure; or
  • Receive information on any aspect related to the processing of your personal data, you may send an email to privacidad@firmaautografa.com, indicating the specific subject of your request.

The Data Subject will have three (3) business days to express their refusal for the processing of their personal data regarding the purposes described in Section 3 of this privacy policy. If no response is received within this period, tacit consent will be assumed for the processing of their data.

5. Transfer of Personal Data.

FAD® DOES NOT transfer your personal data to third parties, except in the following cases:

  • If the Data Subject adheres to any promotions, loyalty programs, reward programs, benefits, or requests to participate in an event organized by the Data Controller.
  • When expressly permitted by law.
  • When exempt from requiring the Data Subject's consent, including but not limited to requests from competent authorities, compliance with a law or international treaty, or a contract requiring such transfer.
  • To verify personal data against official and/or third-party databases.
  • For internal and external audit purposes.

In such cases, FAD® will communicate this privacy policy and the purposes to which the Data Subject has agreed to any third parties receiving or processing personal data.

6. Exercise of ARCO Rights.

At any time, in accordance with the right to informational self-determination, privacy, and personal data protection, you or your duly accredited legal representative may request that FAD®:

  • Access the personal data that FAD® holds about you.
  • Rectify your data if it is outdated or incorrect.
  • Cancel your personal data by blocking and deleting it.
  • Oppose the use of your data for specific purposes outlined in this privacy policy.

To exercise your ARCO rights, please send an email to privacidad@firmaautografa.com, including:

  • Full name.
  • Simple or digital copy of an official ID (voter ID, passport, professional license).
  • If acting on behalf of a minor, a birth certificate or document proving parental or guardianship authority is required. If acting on behalf of an adult, a power of attorney is needed.
  • A brief description of your request (access, rectification, cancellation, opposition, or consent revocation).
  • If requesting rectification, attach supporting documentation.

FAD® will respond within 20 days from the date of the request and, if applicable, will execute the request within 15 days after issuing the response. This period may be extended if justified. If you disagree with our response, you may contact the National Institute for Transparency, Access to Information, and Personal Data Protection (INAI) at www.inai.org.mx to file a claim within 15 business days.

7. Security Measures.

FAD® implements technical, administrative, and physical security measures to protect your personal data in compliance with applicable laws. We also ensure that our data processors adopt similar security measures.

8. Modifications to the privacy policy.

FAD® reserves the right to modify or update this privacy policy at any time. Any changes will be communicated via Privacy Policy or via email. If you disagree with any modifications, you may contact privacidad@firmaautografa.com to express your opposition. For any disputes, the competent authority is INAI (www.inai.org.mx).
